iMEGA TO LAUNCH UIGEA APPEAL IN SEPTEMBER

Further attack on the Unlawful Internet Gambling Enforcement Act planned

The Interactive Media Entertainment and Gaming Association may not have achieved all of its objectives in its last constitutional clash with the US government over the UIGEA, but it was given legal standing by the court and it plans to launch a further attack before the end of September 2008.

On April 1st, 2008 iMEGA filed notice in the Third Circuit Court of Appeals that it will challenge the dismissal of its suit - iMEGA v. Keisler (Acting USAG), et al - challenging the Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA).

President Ed Leyden said this month that the group, which is dedicated to the continued growth and innovation of the Internet, is busy preparing its case and will file in the Third Circuit Court of Appeals before the deadline for the litigation expires at the end of next (September 2008) month.

The Washington-based pressure group, or for that matter the government agencies that it challenges, can be supported by the filing of "amicus briefs" from third parties interested in the case who have relevant information that will help a panel of judges to fairly consider the issues. These third parties can join the action once the disputing parties have filed. iMEGA anticipates that other parties could well join the action, possibly requesting extensions in order to prepare their submissions.

This being the case, the court proceedings could overflow well into 2009
