Daily Fantasy Sports Betting Legal Battle Continues

The question regarding the legality of Daily Fantasy Sports betting in the USA is still up in the air in many jurisdictions as lawmakers get up to speed on the activity. California held a hearing recently regarding daily fantasy sports in an effort to frame the legislature’s approach to the DFS industry moving forward.

The informative hearing was held by the Committee on Governmental Organization, which generally deals with the topic of gaming and was chaired by Assembly member Adam Gray. California’s Attorney General Kamala Harris has also been tasked with examining the legal status of Daily Fantasy sports betting in California. A letter sent to the Attorney General from Assembly member Marc Levine specifically says that the activity is illegal according to the law in California and that Fan Duel and Draft Kings should be ordered to cease and desist doing business in the state. The office of California Attorney General Kamala Harris declined to comment and cited potential interference with the pending investigation into daily fantasy sports and the teams involved.

Daily Fantasy Sports betting is considered by many to be a game of skill but in California any game that involves betting is still considered illegal according to the testimony of Marc Levine who has said during the hearing he believes DFS is gambling.

Other states in America are also looking into the legal viability of DFS such as Illinois where Attorney General Lisa Madigan declared the websites to be illegal gambling under state law, and has sent a letter requesting that both sites post that residents are not eligible to play.

New York Attorney General Eric Schneiderman started the ball rolling with a cease in desist letter to Fan Duel and Draft Kings in November.  An appellate court judge has allowed both firms to continue to operate within the Empire State for the time being as lawmakers sort out this complex issue.
